LEGAL NOTICE
PUBLIC HEARING ON COOPERATIVE AGREEMENT WITH NYS DEPARTMENT OF AGRICULTURE AND MARKETS RELATED TO SEQRA PROCEDURES FOR THE AGRICULTURAL DISTRICTS PROGRAM
NOTICE IS HEREBY GIVEN, That the County Legislature of the County of Chautauqua will meet in the Legislature Chambers, Gerace Office Building, 3 North Erie Street, Mayville, New York at 6:35 p.m. on Wednesday, May 25, 2022, for the purpose of holding a public hearing on entering into a cooperative agreement with New York State Department of Agriculture and Markets related to SEQRA procedures for the Agricultural Districts Program, including utilization of a specific short Environmental Assessment Form (EAF), as described in Article 25-AA of the Agriculture and Markets Law. All persons attending shall have the right to provide comments and ask questions concerning the agreement.
FURTHER NOTICE IS GIVEN, that the Legislature provides this notice and opportunity for a hearing pursuant to Environmental Conservation Law Article 8, and Part 617.14(a) of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York, which states, in relevant part, a requirement that “all agencies to adopt and publish, after public hearing, any additional procedures that may be necessary for them to implement SEQR.”
FURTHER NOTICE IS GIVEN, that the proposed short EAF form is for use in review of actions designated as an “Unlisted Action” pursuant to the State Environmental Quality Review Act (SEQRA), and which involve the modification of an existing Agricultural District, which includes the termination or modification of such district, pursuant to AML section 303-a; the inclusion of viable agricultural land to an existing Agricultural District, pursuant to AML section 303-b; and/or the consolidation of existing Agricultural Districts, pursuant to AML section 303-c. A copy of the proposed EAF is available for public viewing at https://agriculture.ny.gov/land-and-water/short-environmental-assessment-form.
AND FURTHER NOTICE IS GIVEN, that the public may participate in the public hearing by appearing in person at the Legislature Chambers during the 6:35 p.m. public hearing to make a live statement. The hearing facility is handicapped accessible. The meeting is open to the public and subject to current COVID-19 guidelines.
